1. 被告被逮捕或带到后、听取陈述前，司法警察应立即告知指控及沉默权。陈述后未提出免罪事项的，在四十八小时内移送主管检察机关。 2. 检察机关在二十四小时内讯问，并决定审前羁押或释放。
