将因保管、租赁、质押、借用或委托而交付的款项、凭证或其他动产侵占、使用或挥霍，从而损害权利人的，处监禁或罚金。 适用本条时，共有财产的共有人、无因管理他人财产的人，以及接受物品用于为其所有人或他人利益办理特定事项的人，视同受托代理人。
