1. 所有人不得过度行使权利，以致损害邻居财产。 2. 对通常且无法避免的邻里妨害不得追责；超过通常限度的，可请求消除。评估时考虑习惯、各不动产性质、相互位置和指定用途。主管机关许可不妨碍邻居行使该权利。
