1. 买方被启动破产程序前，买卖合同依判决或合同条件解除的，货物、权益或不动产仍以原物存在于债务人财产中的，卖方可取回。 2. 即使合同在启动程序决定后解除，只要取回或解除之诉在决定前提起，亦可取回。 3. 本条取回申请适用第228条相同条件和程序。
