Any person who calls to or incites another person to commit any of the crimes stipulated in Articles (41), (42), (43), or (44), or facilitates the commission thereof in any manner, shall be punished by imprisonment for a period of not less than (5) five years and a fine of not less than (AED 50,000) fifty thousand dirhams. Any act committed in violation of the provisions of Articles (34) and (40) Paragraph (1) of this Decree by Law shall be deemed facilitation. The commission of the crime of calling to, incitement to, or facilitation shall constitute an aggravating circumstance if it in places of public gathering, educational institutions or their service facilities, cultural or sports institutions, places of worship, correctional institutions, detention or pre-trial custody facilities, or if committed against a female, a child, a person suffering from mental illness, or a person in a state of apparent intoxication or drug influence, or if committed deliberately by a physician or pharmacist in violation of the provisions of Articles (34) and (40) Paragraph (1) of this Decree by Law.
