1. A penalty of imprisonment for a period of no less than three months or a fine of no less than twenty thousand dirhams and not more than one hundred thousand dirhams shall be applied in the case of: A. Addicting in any way, or personal using in circumstances other than authorised, or in doses more than specified in the medical prescription, any of the narcotics and psychotropic substances stipulated in Schedules (1), (2), (5), with the exception of Clause (29) from Schedule No. (1); and B. Addicting in any way or personal using in circumstances other than the authorised one of the plants listed in Schedule No. (4), with the exception of Clause (8) of the Section (2) of Schedule No. (4). 2. If the Offender commits any of the acts stipulated in the previous Clause for the second time within a period not more than three years as of the date of committing the act or once, the penalty shall be imprisonment for a period of no less than six months or a fine of no less than thirty thousand dirhams and not more than one hundred thousand dirhams. 3. If the Offender commits any of the acts stipulated in Clause (1) of this Article for the third time or more, the penalty shall be imprisonment for a period of no less than two years and a fine of no less than one hundred thousand dirhams.
