刑事认罪协商不适用于：1. 同态复仇、血金犯罪；2. 危害国家安全犯罪；3.《违法及有违法风险未成年人法》所列犯罪；4. 法律不允许减轻刑罚的犯罪；5. 检察机关适用刑事命令的特定犯罪；6. 与不适用认罪协商的犯罪不可分割关联的犯罪。
