1. 证人依当事人的申请并依本法规定传唤，传唤应至少在庭审日期二十四小时前进行。经当事人申请，证人也可以未经通知直接到庭。 2. 法院审理案件期间认为必要时，可以传唤并听取任何人的陈述，包括签发逮捕带到令；也可以命令其在另一次庭审到场。
