1. 买受人可在法院要求优先权人行使或放弃；其作出任一回答即受约束，不回答的，法院宣告权利消灭。 2. 优先权人请求延期考虑行使或放弃的，买受人可拒绝。 3. 拟购买者在购买前不得要求行使或放弃；购买前要求并放弃的，该放弃不具约束力。
