财务重组与破产法 — 第130条 — Article (130) Death of Debtor During the Assets Inventory Counting

Part Three: Declaration of Bankruptcy · Chapter Two: Effects of Issuance of Decision to Initiate Bankruptcy Proceedings

1. 启动决定在债务人死亡后作出且死亡时未编制清单，或债务人在决定后、清点开始前或完成前死亡的，应依本法第135条机制立即编制或继续编制，并由继承人出席或通知其出席。 2. 债务人在启动破产决定和清单完成后死亡的，继承人取代其参加程序并可指定代表；否则破产法院依本法第21条任命代表。
