Life imprisonment shall be imposed on any public servant, entrusted with guarding a war prisoner or any of the enemy's detained citizens or agents, who deliberately facilitates their escape from detention. The penalty shall be imprisonment for a period not less than (3) three years and not exceeding (5) five years if the act occurs as a result of negligence in guarding.
