因被告精神失常、精神障碍、智力缺陷或严重心理疾病而作出不予起诉决定或无罪判决的，检察机关或法院应视情况命令将其安置于治疗机构，直至该机关决定释放。决定释放前，应审阅收治机构报告；决定非由检察机关作出的，还应听取检察机关意见，并确认被告已恢复正常理智或不再具有危险性。
