1. 被告因犯罪后发生的精神失常、精神障碍、智力缺陷或严重心理疾病而无能力自行辩护的，对其提起诉讼或审判应中止，直至该原因消失。 2. 视情况由检察机关或审理案件的法院命令将被告安置于治疗机构。 3. 诉讼中止不妨碍采取认为紧急且必要的侦查措施。
