1. 用益权因标的物灭失而终止并获得赔偿或保险金的，用益权人的权利转移至该赔偿或保险金。 2. 灭失非因所有人过错的，不得强制其恢复原状；所有人恢复的，如灭失并非用益权人所致，用益权恢复，但另有约定的除外。
