1. 遗产执行人以收取的遗产权利、现金、按市价出售证券所得及动产价款清偿债务；不足的，以遗产不动产价款清偿。 2. 动产、不动产依现行立法程序、时间公开拍卖，但全体继承人同意其他方式的除外；遗产负债时须全体债权人同意。继承人始终有权参加拍卖。
