The provision of the previous Article shall not apply to anyone who possesses a narcotics or a psychotropic substance and shall not handed it over to the Unit, the Public Prosecution Office, or the Police when he applies for treatment or refuses to place an order issued by the Public Prosecution, and the Public Prosecution shall take its affairs on filing a criminal case.
