1. The appeal in cassation shall be established by filing a petition that contains the grounds of such appeal with the Case Management Office of the court to which the appeal is submitted, within thirty [30] days following the date of the judgment. However, if the judgment is rendered as of in presence of the litigants, the time limit for challenging it on cassation grounds shall commence as of the date of its service. The appeal in cassation shall be recorded in the relevant register. 2. If the appeal in cassation is filed by the Public Prosecution, its grounds shall be signed by an officer with a rank of at least Chief Prosecutor, If the appeal in cassation is filed by a party other than the Public Prosecution, its grounds shall be signed by an attorney admitted before the court of cassation. 3. The Case Management Office of the court shall serve upon the Respondent a copy of the statement of appeal in cassation, not later than eight [8] days of the day of recording the appeal in the relevant register. The Respondent may file with the Case Management Office of the court a statement of response to the appeal within eight [8] days of the date of being notified of the same.
