A penalty of temporary imprisonment shall be imposed on any public servant or any person entrusted with a public service who embezzles funds, papers or other things held in his possession ex officio or by reason of his assignment. The penalty shall be temporary imprisonment for a period not less than (5) five years if the crime is indivisibly connected to or associated with a crime of forgery or use of a forged document or forged copy of an official document.
