A penalty of temporary imprisonment shall be imposed on any public servant or any person entrusted with a public service who takes advantage of his profession and unlawfully embezzles the funds, papers or other things of the State or any of the authorities stated in Article (5), or embezzles private papers or funds in his possession or facilitates the same for other persons. The penalty shall be temporary imprisonment for a period not less than (5) five years if the crime is indivisibly connected to or associated with a crime of forgery or use of a forged document or forged copy of an official document.
