Any of the following shall be deemed as recidivist: 1. Any person adjudged by a final judgment in a felony and commits a crime thereafter. 2. Any person adjudged by a final judgment of imprisonment for (6) six months or more and then commits a misdemeanour within (3) three years before the expiry date of such penalty. Recidivism is only consummated in crimes united in of premeditation and mistake. In such events, the court may not deem recidivism as aggravating circumstance.
