1. A commission agent shall not guarantee the fulfillment of his obligations by the third party with whom he contracted, unless he assumed expressly this guarantee, or if such guarantee is stipulated by Law, or if it is customary at the area where he carries out his activity. 2. A commission agent, who is guarantor of the fulfillment by the contractor of his obligations, shall be entitled to an additional remuneration to be determined by the court where there is no agreement or custom in this respect.
