1. If the depositary dies and the deposit is found in kind in their estate, it shall be deemed a trust in the hands of the heirs, who shall return it to its owner. 2. If the heirs prove that the depositary had returned the deposit, or that it had perished or been lost from them without transgression or negligence before or after death, there shall be no liability on the estate. 3. If the depositary dies while concealing the deposit and it is not found in their estate, it shall be a debt due from the estate, and its owner shall rank with the other creditors.
