Article 1195

1. The acquisition of the pre-empted property by judicial order or by agreement shall be deemed a new purchase, which establishes the pre-emptor's right to the option of inspection and the option of defect, even if the purchaser has waived them. 2. The pre-emptor shall not be entitled to benefit from any deferred payment granted to the purchaser for the price, except with the consent of the seller. 3. If entitlement is established in favor of a third party after the property has been taken by pre-emption, the pre-emptor shall have recourse for the price against the person to whom it was paid, whether the seller or the purchaser.
