1.The litigants may, even before the action is instituted, agree to accept the result of the expert's report and the court shall rely on their agreement, unless the report includes items contrary to the public order. 2.Without prejudice to the provision of Clause (1) of this Article, the expert's opinion shall not be binding on the court. If the court does not rely on the expert's opinion in whole or in part, it shall indicate the reasons therefor in its judgment. 3.If the court does not rely on the expert's report, in whole or in part, due to the expert's negligence or fault, it may order him to return all or some of stuff he has received, as the case may be, without prejudice to the disciplinary penalties and the right of stakeholders to claim compensations from him.
