Article 8 — Article (8) DIFC Court Proceedings

A. All DIFC Court hearings shall be held open to the public and all judgements will be announced publicly unless the DIFC Laws or the Rules of the Courts shall stipulate otherwise, or the DIFC Court shall order otherwise of its own initiative. B. In any proceeding, evidence shall be given orally or by affidavit, or as otherwise directed or allowed by the DIFC Courts. A DIFC Court may, for the purposes of any proceeding, direct or allow testimony to be given by video link, telephone, electronic device, or other appropriate means. The testimony shall be given on oath or affirmation unless: 1. the person giving the testimony is in a foreign country; or 2. either the law in force in that country does not permit the person to give testimony on oath or affirmation for the purposes of the proceeding; or the law in force in that country would make it inconvenient for the person to give testimony on oath or affirmation for the purposes of the proceeding; and the DIFC Court deems it appropriate for the testimony to be given otherwise than on oath or affirmation. C. Where the testimony is given otherwise than on oath or affirmation as stipulated in sub-paragraph (B)(2) of this Article, the DIFC Court shall give such testimony the weight it considers appropriate.
