1. If, at the conclusion of the mediation process, the parties reach an agreement for conciliation and settlement of their dispute, in whole or in part, the mediator shall execute the Criminal Mediation agreement and shall have the same signed by the parties as well as the mediator himself. The agreement shall indicate the purport of the mediation and the timeframe set for the Defendant to perform his obligations towards the victim. The Defendant and the victim shall each receive a copy of the mediation agreement, and the same shall be submitted to the Public Prosecution Member for approval. 2. The Defendant shall, within a time limit to be determined by the Public Prosecution and not exceeding two weeks of the approval date of the conciliation and settlement agreement, commence the performance of his obligations covered by the agreement. 3. If the Defendant fails to perform the said obligations, in whole or in part, the competent prosecutor may decide that the criminal action be reinstituted and prosecuted of according to the procedures set forth in this Law.
