Article 108 — Section 9: Provisional Release: Article (108) Provisional Release of Persons Held in Custody

1. The person held in custody for a crime punishable by the death penalty or a life sentence may only be released based on the approval of the Attorney General or his deputy. 2. The Public Prosecution may order the provisional release of the person held in custody or revoke the order of placing the Accused under electronic monitoring, for a felony or a misdemeanor, at any time, whether sua sponte or upon motion of the Accused, unless the accused has been sent to the competent court for trial, as, in which case, his release shall fall within the jurisdiction of the said court.
