Book Three: Banking Transactions · Part Two: Current Account

1. Where either party to the current account is declared bankrupt, no garnishment made over its properties after the date fixed by the court for the suspension of payment may be invoked against the Body of Creditors, in order to secure the potential balance debt to the extent of the debit balance amount at the time when the garnishment is established. 2. Nevertheless, the garnishment may be invoked against the Body of Creditors as to the difference, if any, between the debit balance amount at the time when the garnishment is decided and the balance amount at the time of closing the account, save where it is established that the judgment creditor was aware, when the garnishment was decided, that the debtor had stopped payment.
