1. Upon the request of shareholders holding not less than [5%] of the Company's capital, the SCA may issue a resolution to suspend the enforcement of resolutions passed by the General Assembly of the Company if they are detrimental to the shareholders, in favor of a certain class of the shareholders or bring a special benefit to the Directors or to Third Parties, whenever such request is considered well grounded. 2. Any request to suspend the implementation of resolutions of the General Assembly shall not be admitted after three [3] business days of the issue date of such resolutions. 3. The stakeholders may file a lawsuit to invalidate such resolutions with the competent court and shall forward a copy thereof to the SCA within five [5] days of the issuance date of the resolution suspending the enforcement of the resolutions of the General Assembly; otherwise, the suspension shall be void ab initio. 4. The court shall hear the lawsuit that claims invalidity of the resolutions of the General Assembly, and may order, as a matter of urgency, that the enforcement of the SCA's resolution be suspended upon the request of the opponent until a decision has been rendered on the merits of the lawsuit.
