1. An agent may not delegate the performance of the agency to another person, unless they are authorized to do so by the principal or permitted by law. 2. If an agent entrusts another with the execution of the agency without being authorized to do so, they shall be liable for the act of the second agent as if such act had been performed by them, and both the agent and the second agent shall be jointly and severally liable. 3. If an agent is authorized to appoint another without designating a person, the first agent shall not be liable except for their fault in choosing the second agent or for their fault in the instructions they issued thereto. In this case, both the principal and the second agent may have direct recourse against each other.
