Article 839

1. If the contract is extinguished by the death of the contractor, the employer shall be obliged to pay to the estate the value of the work completed and the expenses incurred for its execution, to the extent of the benefits accruing to the employer, in accordance with the terms of the contract and what is customary. 2. The provisions of Paragraph (1) of this Article shall apply if the contractor has begun the execution of the work and then becomes incapable of completing it for a cause not attributable thereto.
