1. If the seller warrants the fitness of the subject matter of the sale for use for a specified period and a defect appears in the subject matter of the sale during that period, the purchaser shall notify the seller of this defect within one month from its appearance, unless a longer period is agreed upon. 2. If the seller fails to repair the defect, the purchaser may request rescission of the contract with compensation, or retain the subject matter of the sale and claim compensation for the damage suffered due to the defect.
