Article 351

1. The retaining person shall preserve the retained thing and shall render an account of its yield. 2. If the retained thing is at risk of perishing or damage, the retaining person may request permission from the court to sell the retained thing in accordance with the procedures specific to the sale of a possessory pledged, and the right of retention shall transfer from the thing to its price. 3. If the retained thing is perishable or is likely to lose its value such that it is not possible to obtain permission from the court in a timely manner, the retaining person may sell the retained thing at the price of the like, and the right of retention shall transfer from the thing to its price.
