A claim of pre-emption shall not be admissible: 1. If the sale was conducted by public auction in accordance with procedures prescribed by law. 2. If the sale took place between ascendants and descendants, between spouses, or between relatives up to the fourth degree inclusive, or between in-laws up to the second degree. 3. If the pre-emptor has waived their right of pre-emption, expressly or by implication.
