1. The Arbitral Tribunal may, on its own accord or at the request of one of the parties, seek assistance from the court of the State to obtain any evidence. The court may, within its authority, order the fulfillment of such request and order the attendance of witnesses before the Arbitral Tribunal to deliver their oral testimony, or submit documents or any evidentiary materials. 2. The request shall be submitted to the president of the court who may decide to: a. Award against the witness who unduly refrains from appearing, or giving testimony, the penalties stipulated in the laws in force in the State; b. Order a third party to produce any documents in its possession which are necessary to decide on the dispute; or c. Issue orders for judicial delegation.
