Article 239 — Article (239) Examination of Witnesses

1. The court of appeal shall, by itself, examine the witnesses whose testimony should have been given before the court of first instance, and shall complete any other shortcoming in the investigation procedures. 2. In all instances, the court of appeal may order that any investigation be conducted or that any witness testimony be given as deemed necessary, and any witness may only be subpoenaed if so ordered by the Court.
