Article 215 — Article (215) Change of Legal Characterization of the Incident

1. The Court may include in its judgment a change of the legal characterization of the incident imputed to the Defendant, and may change the charge as deemed appropriate in light of the investigation or pleadings at the hearing. 2. The Court shall keep the Defendant notified of such change, and shall grant him a time limit for preparing his defense based on the new description or characterization, if the same is requested by the Defendant. 3. The Court may also correct any typographical error or omission in the words of indictment as contained in the decision to prosecute or in the notice to appear before the court.
