Article 387 — Article (387)

A penalty of temporary imprisonment for a period not exceeding (10) ten years shall be imposed on anyone who commits assault on the physical safety of another person, in any manner, without intending to kill him, but the assault leads to his death. If any of the circumstances stipulated in the second paragraph of Article (384) is fulfilled, this shall be considered an aggravating circumstance. Committing the act while in a state of drunkenness or narcotization shall also be considered an aggravating circumstance, without prejudice to the provisions of Articles (62) and (63).
