Whoever is in charge of guarding, watching, transporting or escorting a person under arrest, and assists him to escape, facilitates his escape, or overlooks it, shall be punished according to the following provisions: 1. If the fugitive is sentenced to death, the penalty shall be temporary imprisonment for a period not less than (5) five years. 2. If the fugitive is sentenced to temporary or life imprisonment or if he is accused of a crime punishable by death, the penalty shall be imprisonment for a period not exceeding (7) seven years. 3. In other cases, the penalty shall be incarceration for a period not less than one year.
