Article 648 — Article (648)

1. A cheque is payable on the date stated as its issue date and may not be presented before that date. 2. If available funds are less than the cheque amount, the drawee shall make partial payment unless the holder refuses. Each partial payment shall be noted on the back; the original cheque and a payment certificate shall be returned to the holder, who may enforce the balance under Article 667 or protest after the Article 663 periods. 3. The drawee shall notify the Central Bank of the account-holder particulars under its rules if the cheque lacks sufficient available funds at maturity, the drawer withdraws all funds after issue, or the drawee makes partial payment.
