1. Where a broker designates another person to perform the task assigned to him without being authorized to do so, he shall be liable for the designee's action as if such action has been made by him; however, both the broker and his designee shall jointly assume the liability. 2. Where the broker is authorized to designate a designee without naming the person of such designation, the broker shall be liable only for his fault in selecting his designee or his fault in the instructions issued by him to the designee. 3. In all cases, the person who has assigned the broker may have direct recourse against the designee.
