1. If the insured, in bad faith, conceals a matter or provides an incorrect statement in a manner that diminishes the materiality of the insured risk or leads to a change in its subject matter, or if they fraudulently breach their undertakings, the insurer may demand the termination of the contract and may claim the premiums due before such demand. 2. If fraud or bad faith is absent, the insurer, upon demanding rescission, shall return to the insured the premiums they have paid or the portion thereof in respect of which no risk was borne.
