1. If the depositary incurs expenses on the deposited property without the permission of the depositor or the court, they shall be deemed to have acted gratuitously. 2. The depositary may, in cases of urgency or necessity, incur expenses for the deposit to the customary extent, and shall have recourse for their expenditure against the depositor.
