1. If the gifted property becomes subject to entitlement after it has perished while in the possession of the donee, and the entitled party chooses to have recourse against the donee for the guarantee, the latter may claim from the donor what they have guaranteed to the entitled party. 2. If the gifted property becomes subject to entitlement and the donee has made an addition to the gifted property that cannot be separated without damage, the entitled party may not recover it before paying the value of the addition.
