1. If an entitlement claim (rei vindicatio) is brought against the purchaser in respect of the subject matter of the sale based on a right predating the sale or deriving from the seller, the purchaser may withhold the price until the seller provides a suitable guarantee or a solvent surety who ensures the return of the price to the purchaser upon establishment of the entitlement. The seller may request the court to order the purchaser to deposit the price with it instead of providing the guarantee or a surety. 2. The provision of Paragraph (1) of this Article shall apply if it becomes apparent to the purchaser that the subject matter of the sale has an old defect guaranteed by the seller.
