Article 1406

Book Four: Real Securities · Section Three: Privilege · Chapter Two: Types of Privilege · Part One: General Privileges and Special Privileges over Movables

1. Judicial expenses incurred for the common benefit of all creditors in preserving and selling the debtor's property shall have a privilege over the price of such assets. 2. The expenses referred to in Paragraph (1) of this Article shall be paid before any other right, even if it is privileged or secured by a mortgage, including the rights of creditors for whose benefit the expenses were incurred. Expenses incurred in the sale of assets shall have precedence over those incurred in the distribution procedures.
