1. The owner of the dominant property may exercise their right of easement within the legitimate limits and may carry out what is necessary for its use and maintenance without increasing the burden of the easement, and shall use this right in a manner that results in the least harm. 2. If new needs of the dominant property arise in a manner that would increase the burden of the easement, the court may, after balancing the interests of the two parties, order the modification of the easement to the extent required to address such increase, in return for fair compensation.
