1. The manifestation of will shall be: a. By words or in writing, and it may be in the past tense, as well as in the present or imperative tense, where either is intended to express the present. b. By a gesture customarily understood, even from a person who is not mute. c. By an actual exchange indicating consent. d. By adopting any other course of conduct which, in the circumstances of the case, leaves no doubt as to its indication of consent. 2. The manifestation of will may be implicit, unless the law provides or the two parties agree that it must be explicit.
