The pre-empted property shall be a divisible immovable property which one of the co-owners has transferred by way of a commutative contract, even if such transaction is effected by way of exchange for a similar immovable property, or if the property was a building or trees owned by two co-owners on endowed land. If the property is not divisible, no right of pre-emption shall arise in respect thereof.
