If the owner of the lower floor refrains and the owner of the upper floor rebuilds the building without the permission of the Court or the owner of the lower floor, they may have recourse against the owner of the lower floor for their share of the value of the building at the time of reconstruction. 3. If the owner of the upper floor rebuilds the lower floor without first referring the matter to the owner of the lower floor and establishing their refusal, the owner of the upper floor is deemed to have acted gratuitously and shall have no right of recourse. 4. The owner of the upper floor may, in the two cases provided for in Paragraphs (1) and (2) of this Article, prevent the owner of the lower floor from disposing of and using the property until their right is satisfied.
